OVERVIEW Welcome to Eurotypo! The terms “we”, “us” and “our” refer to Eurotypo. By visiting our site and/or purchasing our Font Software ("Products"), you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink (specifically, the End User License Agreement or "EULA" associated with your purchase).

SECTION 1 - DIGITAL PRODUCTS & NO REFUND POLICY You acknowledge that the Products available on this store are digital files (software).

  • Immediate Access: Upon purchase and payment confirmation, you will receive access to download the files immediately.
  • No Refunds: Due to the nature of digital goods, all sales are final. We do not offer refunds, returns, or exchanges once the download links have been generated, except in the case of proven technical defects in the software that cannot be resolved by our support team.
  • Licensing: Your purchase grants you a license to use the Font Software, not ownership of the design or intellectual property. The specific rights of use (Desktop, Webfont, Apps, ePub, or Digital Ads) are defined in the EULA selected at checkout.

SECTION 2 - ACCESS AND ACCOUNT By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage. To use the Services, including accessing or browsing our online stores or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, and payment information. You represent and warrant that all the information you provide in our stores is correct, current and complete and that you have all rights necessary to provide this information. You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.

SECTION 3 - PRODUCTS AND SERVICES We have made every effort to display as accurately as possible the characteristics of our typefaces (weights, styles, glyph sets). However, we do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations beyond the technical specifications provided. We reserve the right to limit the sales of our products or Services to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

SECTION 4 - ORDERS AND BILLING We reserve the right to refuse any order you place with us. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

SECTION 5 - DELIVERY OF DIGITAL GOODS

  • Delivery Method: Products are delivered via digital download links sent to the email address provided at checkout or available directly on the order confirmation page.
  • Responsibility: You are responsible for providing a valid email address and ensuring your spam filters allow emails from Eurotypo. We are not responsible for download failures resulting from your hardware, software, or internet connection limitations.
  • Backup: We recommend you make a backup copy of the Font Software immediately upon download. We do not guarantee indefinite storage of your download links.

SECTION 6 - INTELLECTUAL PROPERTY & LICENSE AGREEMENT All content included on this site (text, graphics, logos, images, digital downloads) is the property of Eurotypo and protected by international copyright laws. Crucially: The purchase of a font file constitutes the purchase of a License to Use, subject to the specific EULA (End User License Agreement) you selected (Desktop, Webfont, Apps, ePub, or Digital Ads).

  • You may NOT redistribute, resell, lease, license, sub-license, or offer our files to any third party "as is" or as a separate attachment.
  • You may NOT modify, reverse engineer, or create derivative works based on our Font Software without express written permission.
  • Unauthorized use of the Services may be a violation of federal and state intellectual property laws. All rights not expressly granted herein are reserved by Eurotypo.

SECTION 7 - THIRD-PARTY LINKS The Services may contain materials and hyperlinks to websites provided or operated by third parties. We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites you choose to access. If you decide to leave the Services to access these materials or third party sites, you do so at your own risk. We are not liable for any harm or damages related to your access of any third-party websites, or your purchase or use of any products, services, resources, or content on any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction.

SECTION 11 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY We do not guarantee that the Font Software will work perfectly on every operating system or software version forever. While we adhere to industry standards (OpenType/TrueType/WOFF), technical compatibility is the user's responsibility. THE SERVICES AND ALL PRODUCTS DELIVERED TO YOU THROUGH THE SERVICE ARE (EXCEPT AS EXPRESSLY STATED BY US) PROVIDED 'AS IS' AND 'AS AVAILABLE' FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. TO THE FULLEST EXTENT PERMITTED BY LAW, EUROTYPO SHALL NOT BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES.

SECTION 12 - INDEMNIFICATION You agree to indemnify, defend and hold harmless Eurotypo and our affiliates, partners, officers, directors, agents, contractors, licensors, and service providers from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SECTION 13 - SEVERABILITY In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 14 - TERMINATION The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
